Marisha Nores et al v. Raising Cane’s Restaurants, LLC et al

Seth Pohlmann and Peter Wanek argued and won a Motion for Summary Judgment (MSJ) on liability on behalf of Raising Cane’s in a case where the plaintiff had slipped and fallen, alleging injuries to her neck and back and undergoing a two-level cervical fusion, lumbar epidural steroid injections, and was recommended an adjacent cervical fusion surgery. The plaintiff had filed a cross-MSJ on the same issue (liability), which was denied. In reaching its conclusion, the court reasoned that Cane’s acted reasonably in response to a customer’s spill.
